The entries are summaries compiled from that country’s fishing legislation; each lists its legal basis and official source. The official text is binding, and rules can vary by state and by water. Check the rules on your permit before you fish.
Legal framework and permits
Natural Heritage and Biodiversity Act (Ley 42/2007 (13.12.2007); Art. 64, 64 bis, 64 ter, 65). Basic (framework) state legislation. Hunting and fishing may only be carried out in a manner compatible with species conservation (Art. 65). Possession, transport, trade and release into the wild of species included in the catalogue of invasive alien species is prohibited (Art. 64). Art. 64 ter (added by Ley 7/2018): catalogue species introduced into the wild before 2007 and of fishing value (carp, black bass, rainbow trout, etc.) may be fished only within their pre-2007 distribution areas, within the framework of control or eradication. The CCAA define these areas with maps. The CCAA may authorise the stocking of rainbow trout. Competence for freshwater fishing lies with the autonomous communities (CCAA). Licence: there is no single national licence. Each CCAA issues its own freshwater fishing licence. There is also a 'licencia interautonómica de pesca' agreement valid among several CCAA (2015 agreement; recognised by CyL). Competent authority: MITECO (Ministry for the Ecological Transition) for basic legislation; implementation by CCAA environment/fisheries departments.

Act amending Act 42/2007 (Ley 7/2018 (20.07.2018), BOE-A-2018-10240). Through Art. 64 ter it again made it possible to fish invasive species established before 2007 (carp, black bass, pike, zander, wels catfish, rainbow trout) in designated areas. Specimens caught outside these areas may not be returned to the water and must be killed. Competent authority: Cortes Generales / MITECO.
